ARTICLE 2- SUBJECT

The subject of this contract is to determine the rights and obligations of the parties in accordance with the Law No. 4077 on the Protection of Consumers and the Regulation on Principles and Procedures for Distance Contracts, regarding the sale and delivery of the product whose characteristics and sales price are specified below, which the BUYER has ordered electronically through the ELISIN website belonging to the SELLER.

ARTICLE 4- GENERAL PROVISIONS

4.1- The BUYER declares that they have read and informed themselves about the basic characteristics, sales price, payment method, and preliminary information regarding delivery of the contractual product on the Elisin website and have given the necessary confirmation electronically.
4.2- The contractual product shall be delivered to the BUYER or the person/entity at the address indicated within the period explained in the preliminary information on the website, depending on the distance of the BUYER's residence, provided that it does not exceed the legal 30-day period.
4.3- If the contractual product is to be delivered to a person/entity other than the BUYER, the SELLER cannot be held responsible if the recipient does not accept the delivery.
4.4- The SELLER is responsible for delivering the contractual product in a sound, complete manner, in accordance with the specifications in the order, and with warranty documents and user manuals, if any.
4.5- For the delivery of the contractual product, a signed copy of this contract must be received by the SELLER and the price must be paid via the BUYER's preferred payment method. If the product price is not paid for any reason or is canceled in the bank records, the SELLER is deemed released from the obligation to deliver the product.
4.6- If, after the delivery of the product, the BUYER's credit card is used unfairly or unlawfully by unauthorized persons in a way that is not caused by the BUYER's fault, and the relevant bank or financial institution does not pay the product price to the SELLER, the BUYER must return the product to the SELLER within 3 days. In this case, shipping costs belong to the BUYER.
4.7- If the SELLER cannot deliver the contractual product within the period due to force majeure or extraordinary circumstances such as adverse weather, the SELLER is obliged to notify the BUYER. In this case, the BUYER may use one of the rights to cancel the order, replace the product with its equivalent, and/or postpone the delivery. If the BUYER cancels the order, the amount paid shall be refunded in cash within 10 days.
4.8- Defective or broken products, whether sold with a warranty certificate or not, can be sent to the SELLER for repair within the warranty terms; in this case, shipping costs will be covered by the SELLER.

ARTICLE 5- RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw within 7 days from the delivery of the contractual product to them or the person/entity at the indicated address. To exercise the right of withdrawal, the SELLER must be notified by fax, e-mail, or telephone within this period and the product must be unused according to Article 6. In case of exercise, the original invoice and the cargo delivery report must be returned. The product price is refunded within 7 days following the receipt of these documents. If the original invoice is not sent, VAT and other legal obligations cannot be refunded. Shipping costs for returns due to withdrawal are covered by the SELLER.

ARTICLE 6- PRODUCTS FOR WHICH WITHDRAWAL IS NOT APPLICABLE

The right of withdrawal cannot be used for products that cannot be returned due to their nature, single-use products, copyable software, or products that expire quickly. Withdrawal for the following depends on the packaging being unopened and unused:

- Laptops (No return after OS installation)
- All software and programs
- DVDs, VCDs, CDs, and cassettes
- Computer and stationery consumables (toner, cartridge, etc.)
- All cosmetic products
- Phone top-up orders

ARTICLE 7- AUTHORIZED COURT

In the implementation of this contract, Consumer Arbitration Committees and Consumer Courts in the BUYER's or SELLER's place of residence are authorized up to the value declared by the Ministry of Industry and Trade.

In case of the completion of the order, the BUYER is deemed to have accepted all terms of this contract.
