ARTICLE 2 - SUBJECT

The subject of this contract is the determination of the rights and obligations of the parties in accordance with the provisions of Law No. 4077 on the Protection of Consumers and the Regulation on Principles and Procedures for the Implementation of Distance Contracts, regarding the sale and delivery of the product, the characteristics and sales price of which are specified below, ordered by the BUYER electronically via the SELLER's website (ELİSİN).

ARTICLE 4 - GENERAL PROVISIONS

4.1- The BUYER declares that they have read and informed themselves about the basic characteristics of the product, the sales price, the payment method, and the preliminary information regarding delivery on the Elisin website, and that they have provided the necessary confirmation in the electronic environment.

4.2- The product subject to the contract shall be delivered to the BUYER or the person/organization at the address indicated within the period described in the preliminary information on the website, depending on the distance of the BUYER's residence, provided that it does not exceed the legal period of 6-20 days.

4.3- If the product subject to the contract is to be delivered to a person/organization other than the BUYER, the SELLER cannot be held responsible if the recipient person/organization does not accept the delivery.

4.4- The SELLER is responsible for delivering the product subject to the contract in a sound, complete manner, in accordance with the qualifications specified in the order, and with warranty documents and user manuals, if any.

4.5- For the delivery of the product subject to the contract, it is required that a signed copy of this contract has been delivered to the SELLER and the price has been paid by the BUYER's preferred payment method. If for any reason the product price is not paid or is canceled in the bank records, the SELLER is deemed to be released from the obligation to deliver the product.

4.6- After the delivery of the product, if the relevant bank or financial institution does not pay the product price to the SELLER due to the unfair or unlawful use of the BUYER's credit card by unauthorized persons in a way not caused by the BUYER's fault, the BUYER is obliged to return the product to the SELLER within 3 days, provided that it has been delivered to them. In this case, the shipping costs belong to the BUYER.

4.7- If the SELLER cannot deliver the product subject to the contract within the period due to force majeure or extraordinary circumstances such as weather conditions preventing transportation or interruption of transportation, the SELLER is obliged to notify the BUYER. In this case, the BUYER may use one of the rights to cancel the order, replace the product subject to the contract with its precedent, if any, and/or postpone the delivery period until the obstructive situation disappears. If the BUYER cancels the order, the amount paid shall be paid to them in cash and in full within 10 days.

4.8- Products that are defective or broken, whether sold with a warranty certificate or not, can be sent to the SELLER for the necessary repairs within the warranty conditions; in this case, the shipping costs will be covered by the SELLER.

ARTICLE 5 - RIGHT OF WITHDRAWAL

The BUYER has the right of withdrawal within 7 days from the delivery of the product subject to the contract to themselves or the person/organization at the address indicated. To exercise the right of withdrawal, the SELLER must be notified by fax, e-mail, or telephone within this period, and the product must be unused within the framework of the provisions of Article 6. If this right is exercised, it is mandatory to return the original invoice and a copy of the cargo delivery report stating that the product delivered to the 3rd party or the BUYER has been sent to the SELLER. Following the receipt of these documents, the product price is returned to the BUYER within 14 days. If the original invoice is not sent, VAT and other legal obligations, if any, cannot be refunded. The shipping cost of the product returned due to the right of withdrawal shall be covered by the BUYER.

ARTICLE 6 - PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be used for products that cannot be returned due to their nature, single-use products, copyable software and programs, products that deteriorate rapidly, or products whose expiration date has passed. For the following products, the exercise of the right of withdrawal is subject to the condition that the packaging of the product is unopened, intact, and the product is unused:

• Portable Computers (No returns will be accepted after the original operating system is installed.)

• All kinds of software and programs

• DVDs, VCDs, CDs, and cassettes

• Computer and stationery consumables (toner, cartridge, ribbon, etc.)

• All kinds of cosmetic products

• Telephone credit (top-up) orders

ARTICLE 7 - CUSTOMS

When you order products from outside of Turkey, you may be subject to import duties and taxes applied when the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges. Additionally, please be advised that you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the products. Your privacy is important to us, and we would like to inform our customers that products subject to cross-border delivery may be opened and inspected by customs authorities.

ARTICLE 8 - AUTHORIZED COURT

In the implementation of this contract, Consumer Arbitration Committees up to the value declared by the Ministry of Industry and Trade, and Consumer Courts in the SELLER's place of residence are authorized.

In the event of the realization of the order, the BUYER is deemed to have accepted all the terms of this contract.
